The Competition Appeal Tribunal has agreed to extend the time to opt into the Truck Cartel claim to 28 February, 2025 following a request by the Road Haulage Association (RHA).
The organisation considered that further time was necessary given the substantial period of time that has passed since the claim was first issued in July 2018. The RHA says it is currently experiencing a high volume of enquiries regarding the claim, both from operators who had previously signed up and from new class members that wish to join the claim.
The Tribunal agreed that to ensure effective access to justice for operators, it is appropriate to grant potential class members further time to sign up.
The RHA is particularly keen to hear from operators who registered an interest in the claim previously but have yet to sign up. Even if you previously signed up to the claim, since August 2024, you have been required to take further steps to opt into the RHA’s claim to ensure you can benefit.
The claim has come about because European truck manufacturers (MAN, Volvo/Renault, Daimler/Mercedes, Iveco, DAF, and Scania) have been found guilty of a serious abuse of EU competition rules. Over a 14-year period, the manufacturers at senior manager level agreed gross list prices, agreed the cost that truck purchasers should be charged for emissions technologies (Euro 3, 4, 5, and 6), and delayed the introduction of emissions technologies.
Any operator can claim if they bought a new or second-hand truck, six tonnes or over, from any of these manufacturers between 17 January, 1997 and 31 January, 2014. You do not need to be an RHA member to join the claim.
